Terms and Conditions

• At Beitus LLC, we are committed to delivering premier digital media and marketing services for the Commercial and Real Estate industry in Southwest Michigan. These Terms and Conditions (“Terms”) govern your purchase and use of our services. By engaging with us, you agree to these Terms as outlined below. Beitus LLC reserves the right to modify these Terms at any time; however, the Terms in effect at the time of media capture or payment (whichever occurs first) will govern your agreement.
  These Terms apply to, but are not limited to, real estate agents, brokers, business owners, and salespersons purchasing the following services:
  
• Listing Photography
• Twilight/Daylight Exteriors
• Zillow 3D Home Tours
• Matterport Virtual Tours
• Video Highlight Reels
• Agent-Guided Tour Videos
• Aerial Photography & Video
• On-Ground Photography & Video
• Package Bundles

• 1.0 License & Usage

1.1 Ownership & Copyright
Beitus LLC retains full copyright and ownership of all media (“Media”) produced, including but not limited to photographs, videos, virtual tours, and derivative works.
1.2 Grant of License
A non-exclusive, non-transferable license is granted upon full payment and delivery of Media. This license:
Permits use for marketing the property featured in the Media (e.g., MLS, Zillow, Realtor.com, Personal social media).
Allows personal promotion by the purchasing agent/broker in perpetuity.
Prohibits transfer, sublicensing, or use by parent companies/brokerages (unless agreed in writing).1.3 Third-Party Requests
Any requests for Media usage by third parties must be referred to Beitus LLC. Additional licensing fees may apply.
1.4 Prohibited Modifications
The license terminates immediately if Media is:
Altered (color correction, object removal, virtual staging, etc.).
Used to misrepresent property conditions (e.g., hiding defects).
Edits must be performed exclusively by Beitus LLC unless written authorization is provided.1.5 Quality Assurance
We reserve the right to use industry-standard editing tools to ensure the highest quality deliverables.

• 2.0 Mileage & Travel Fees

Service Area: No additional charge within 25 miles of Portage, MI.
Outside Service Area: Mileage fees apply and will be calculated at booking.

• 3.0 Payments & Booking

3.1 Payment Terms
Payment is due at booking via our online portal.
Invoices (if used) are due within 29 days of media capture.
Late Fees: 15% penalty after 30 days, accruing monthly until paid.3.2 Booking Policy
Online booking is strongly preferred to minimize administrative burdens.

• 4.0 Cancellations & Refunds

4.1 Cancellation Fee
Less than 24 hours’ notice: $65 fee (due to lost booking opportunities).4.2 No Refunds After Delivery
Media cannot be refunded once delivered (time/effort expended).4.3 Quality Guarantee
Photography: One (1) free reprocessing within 7 days if Media fails to meet portfolio standards.
One (1) reshoot within 14 days if defects persist (Beitus LLC’s discretion).
Video Products: No re-edits after delivery (additional edits billed at $50+ per request).Exclusions: Minor defects, weather conditions, or property unpreparedness do not qualify.

• 5.0 Appointment & Property Access

5.1 Scheduling Flexibility
Arrival window: 15 minutes before/after scheduled time.
Access Required:
2 hours for photography.
4 hours for video/virtual tours.
Denied Access: No refund if arrival is within the 15-minute window.5.2 Property Preparation
Unprepared Properties: We wait up to 30 minutes; incomplete shoots are billed in full.

• 6.0 Inclement Weather Policy

Indoor Shoots Proceed; exteriors may be rescheduled within 7 days (weather permitting).
Refunds:
Full refund if no Media is delivered.
50% refund if partial Media is delivered (<2 exterior + 12 interior images).
Weather-Related Reshoots: Billed at standard rates, no extra charge from the price of the booked service/package.

• 7.0 Media Retouching & Branding

No Unauthorized Edits (terminates license).
Logo Removal: Prohibited on branded videos (contact for unbranded pricing).
Third-Party Edits: Only permitted with written authorization from Beitus LLC (excludes misrepresentation).

• 8.0 General Terms

Language Interpretation: Terms apply to all Media types (photos, videos, tours, etc.).
Governing Law: Michigan law applies.
